Amendments to the Marriage Act mean s5 defines marriage as the union of a man and a woman to the exclusion of all others voluntarily entered into for life.
A decision of a single judge of the Family Court of Australia following those amendments to the Marriage Act refused to recognise the validity of a potentially polygamous Iranian marriage. The Full Court of the Family Court of Australia in Ghazel & Ghazel and Anor [2016] FamCAFC 31 has over-ruled that decision and declared the marriage valid.
